During 2009, not a single felony case went to jury trial in Sequoyah county.  Not A Single One..

District wide, the stats are not much better with less than 12 felony cases going to jury trial in the remaining three counties.  The national average is 150 in 10,000 or 3 - 4 times the number of cases that were taken to trial last year by the current DA.

While this alone is a major issue, it only tells part of the story.  Without strong verdicts to balance the plea bargains against, the criminals end up with the best outcome.  This is evidenced today by the large number of plea bargains that result in a suspended sentence.  Further evidence of this can be seen by the large number of cases that have charges reduced from felonies to misdemeanors.  The end result is that criminals (including rapists, molesters and drug dealers) are still walking our streets.

Brian Kuester will set the standards necessary to reverse this trend.  By ensuring that strong cases are built by working with law enforcement and taking them to trial, plea deals that are made will rapidly shift from favoring the criminal to favoring the community.  Brian will also spend more time working with the law enforcement community so that they can be better able to perform solid investigations that result in the removal of criminals from our towns through successful prosecutions.
